Welcome to Visuan. These Terms of Service ("Terms") govern your access to and use of the Visuan service, website at visuan.ai, and related products (collectively, the "Service") operated by Tetiana Zhydkova, Individual Entrepreneur, registered in Ukraine ("Visuan", "we", "us", or "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Visuan is a software-as-a-service product that helps users generate branded images and content from blog articles using artificial intelligence. The Service is delivered through visuan.ai and any related applications we make available.
You must be at least 18 years old and able to enter into a legally binding agreement to use the Service. By creating an account, you confirm that you meet these requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@visuan.ai if you suspect unauthorized use of your account.
Each account is intended for a single user. You may not share your account credentials with other people or allow multiple individuals to use the same account.
We offer the following plans:
All payments are processed by Paddle.com Market Limited ("Paddle"), our authorized reseller and Merchant of Record. By purchasing a subscription, you agree to Paddle's terms of service in addition to these Terms.
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. The renewal will be charged using the payment method on file.
We may change our pricing at any time. Price changes will not affect your current billing period; they will apply to the next renewal, and we will notify you in advance.
You may cancel your subscription at any time directly from your dashboard. Upon cancellation, you will retain access to the Service until the end of your current billing period. After that, your account will be downgraded to the Free Plan.
We do not offer pro-rated refunds for partially used billing periods, except as described in our Refund Policy.
Refunds are governed by our Refund Policy, which forms part of these Terms.
Your content: You retain full ownership of the content you upload to the Service, including blog URLs, articles, and any text or media you provide ("Input Content"). You also retain full ownership of the images and content generated for you through the Service ("Output Content"), and you may use Output Content for any lawful purpose, including commercial use.
License to us: You grant Visuan a limited, non-exclusive, royalty-free license to process your Input Content and generate Output Content as part of providing the Service.
Marketing use: We will not use your Output Content in our marketing, case studies, or portfolio without your prior written consent.
Our intellectual property: All rights to the Visuan Service itself, including the website, software, branding, and underlying technology, remain with Visuan. These Terms do not grant you any rights to our intellectual property beyond the right to use the Service as described.
You agree not to use the Service to generate, upload, or distribute content that:

We reserve the right to remove content that violates these rules and to suspend or terminate accounts that engage in prohibited activities, without refund.
We may suspend or terminate your account at any time if you breach these Terms, including the Acceptable Use rules in Section 7. In cases of serious or repeated violations, termination may be immediate and without refund.
You may terminate your account at any time by cancelling your subscription and contacting us at hello@visuan.ai to request account deletion.
After termination, we retain your data for 30 days in case of accidental cancellation, after which it is permanently deleted, unless we are required to retain it for legal reasons.
We strive to maintain high availability of the Service but do not guarantee uninterrupted operation. The Service may experience scheduled maintenance, unexpected downtime, or temporary outages caused by third-party providers (such as cloud hosting or AI services) that are outside our control.
We will make reasonable efforts to notify users of planned maintenance in advance.
The Service relies on third-party providers, including but not limited to OpenAI, Anthropic, Supabase, Vercel, Clerk, and Paddle. By using the Service, you acknowledge that these providers have their own terms and privacy policies, and that interruptions or changes to these third-party services may affect Visuan.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
AI-generated content may contain errors, inaccuracies, or unexpected results. You are responsible for reviewing all Output Content before using it for any purpose, including commercial publication.
We do not warrant that the Service will meet your specific requirements, be error-free, or produce specific business results.
To the maximum extent permitted by law, Visuan's total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.
We are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.
This limitation does not apply to liability that cannot be excluded under applicable law, including liability for gross negligence or willful misconduct.
You agree to indemnify and hold Visuan harmless from any claims, damages, or expenses arising from your use of the Service, your Input Content, your Output Content, or your breach of these Terms.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 14 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Ukraine, without regard to its conflict of law principles.
In case of a dispute, the parties agree to first attempt resolution through good-faith negotiations for a period of 30 days. If the dispute cannot be resolved through negotiation, it shall be submitted to the courts of Ukraine at the location of the seller's registered address (Lutsk, Ukraine).
If you are a consumer residing in the European Union, you retain the right to bring proceedings in the courts of your country of residence under applicable EU consumer protection law.
